IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF HANGRY JOE'S TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO HANGRY JOE'S IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

The limitations of liability set forth in this section are fundamental elements of the basis of the bargain between Hangry Joe's and you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the limitations above may not apply to you.

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, YOU AND HANGRY JOE'S AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT.

The arbitration shall be administered by a nationally recognized arbitration organization, such as the American Arbitration Association (AAA) or JAMS, in accordance with its applicable arbitration rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The arbitrator shall have the authority to award any remedy that would otherwise be available in a court of law. The arbitrator shall not have authority to award punitive damages in excess of the limitations set forth in these Terms.

14.3 Class Action Waiver

YOU AND HANGRY JOE'S AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

14.4 Small Claims Court

Notwithstanding the foregoing, you and Hangry Joe's each retain the right to pursue in small claims court any dispute that falls within the jurisdictional limits of the applicable small claims court, provided the matter remains in small claims court and proceeds only on an individual basis.

15. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you access or use our Services. We reserve the right, in our sole discretion and without liability to you or any third party, to:
